Allgemeine Geschäfts- und Teilnahmebedingungen (AGBs)

  1. scope
    These General Terms and Conditions of Business and Participation (GTCs) apply to all services and offers of the Paderborn Football School, a civil law partnership (GbR) under the name Kasten, Küting & Wiesner   (hereinafter referred to as "Paderborn Football School". ).
     

  2. Services
    The Paderborn football school offers football camps, group training and individual training with a focus on basic techniques, player development and individual sporting analysis. The aim is to create experiences that contribute to improving the skills and performance of the participants.
     

  3. Conditions of participation & conclusion of contract
    3.1 Participants who are not yet of legal age will be represented by their legal representatives when submitting legal and quasi-legal declarations. The legal representatives assume full liability for payment obligations of any kind towards the Paderborn Football School. A medical declaration of no objection is required, provided that it is not purely a matter of leisure activities. The Paderborn Football School reserves the right to reject participants without giving reasons or to exclude them from further offers.
     

  4. Registration and payment
    4.1 All offers from the Paderborn Football School are without obligation and only serve to encourage the customer to submit an offer. A contract is concluded with the consent of the Paderborn Football School, which is expressed in the form of a confirmation of participation. This confirmation of participation also represents the sending of an invoice for the respective course participation.

    4.2 The Paderborn Football School usually calculates and invoices the costs for its courses and football camps in advance and due immediately. Customers are obliged to pay the full amount of the invoice to the Paderborn Football School by the payment date stated on the invoice. The receipt of the money on the account specified in the invoice is decisive for the timeliness of the payment. All bank fees that arise in connection with the payment (in particular fees for returned direct debits caused by the customer) are borne by the customer.
     

  5. Changes and Cancellations
    5.1 If a customer cancels individual units or courses as well as football camps without the Paderborn Football School breaching its duty, the customer is generally obliged to pay 100% of the agreed remuneration to the Paderborner football school if the cancellation takes place within the last 14 days before the start of the course, unit or football camp.

    5.2 In order to terminate (cancel) the contract, the declaration must always be made in writing and it only becomes effective when it has been received by the other contractual partner. If the terminated contractual partner confirms the termination in writing, it does not matter whether the written form was not followed.
     

  6. Liability and obligations of the participants or their legal representatives
    6.1 Liability for own errors, including legal representatives and vicarious agents, is asserted:

    6.1.1 The Paderborn Football School is not liable for damage resulting from participation in the offers, unless these are based on a grossly negligent or intentional breach of duty by the Paderborn Football School.

    6.1.2 The customer is responsible for meeting certain requirements that are necessary for participation in certain events (e.g. age, state of health). The Paderborn Football School points out special requirements for special courses if they do not result from the type of event itself.

    6.1.3 The Paderborn Football School will hold courses and camps in all weathers. In cases where the weather poses a danger to the participants (such as hurricanes or unplayable pitches) or other cases of force majeure, the Paderborn Football School has the right to cancel services. The Paderborn Football School is not liable for non-performance or damage due to cancellations due to force majeure.

    6.1.4 The Paderborn Football School has the right to cancel courses and football camps at any time without compensation if the required number of participants is not reached. If the parties cannot agree on a replacement course or camp, the course fees already paid will be fully refunded. Further claims by the customer, such as damages or reimbursement of unnecessary costs (e.g. purchase of equipment or travel expenses), are excluded.​

    6.2 During the units, courses and camps, the participant must always comply with the general rules of conduct (no vandalism, etc.) and the instructions of the Paderborn Football School. If he does not follow these rules and instructions and this disrupts the proper implementation and this is his fault, the Paderborn Football School has the right to exclude him from the unit, course or camp. In such a case, there is no entitlement to a (proportional) refund of the course fees.

    6.3 By concluding the contract or by registering for the course, the customer (or their legal representative) confirms that they are healthy and physically fit. He (or his legal representative) is also obliged to inform the Paderborn Football School in writing of any health impairments and necessary medical treatments, including the intake of medication.

    6.4 When concluding the contract or registering for the course, the customer or his/her legal representative must confirm that they have health and liability insurance. If the customer becomes ill or injured during the course, he/she authorizes the Paderborn Football School to take all necessary measures for his/her medical care and/or repatriation home on behalf and at the customer's expense. If this results in costs, the customer is obliged to reimburse them. In an emergency, the legal representative of the minor agrees to medical treatment or a necessary surgical measure if the consent of the legal guardians cannot be obtained in good time.
     

  7. privacy
    7.1 The Paderborn Football School attaches great importance to the protection of the personal data of its participants and customers. All data collected will be processed in accordance with the applicable data protection regulations.

    7.2 The participants hereby agree that the Paderborn Football School processes their personal data to provide services, to fulfill legal obligations and for market research and to send offers and information.

    7.3 Participants have the right to revoke their consent to the processing of their personal data at any time. This can be done in writing to the Paderborn Football School.

    7.4 The customer (or his/her legal representative) agrees that photos, film material or other audiovisual services created by the Paderborn Football School or its assistants during the units, courses or camps may be used by the school may be published without restrictions in terms of time, space or content for public purposes and commercial purposes in all media, including the Internet and social networks.
     

  8. Final Provisions
    8.1 The law of the Federal Republic of Germany applies exclusively. Place of jurisdiction is Geseke.

    8.2 Should individual provisions of these General Terms and Conditions of Business and Participation be or become invalid, the validity of the remaining provisions shall remain unaffected. The ineffective provision is to be replaced by one that comes as close as possible to the meaning and purpose of the ineffective provision in legal terms.

    8.3 These General Terms and Conditions of Business and Participation apply from October 1st, 2022 and can be adjusted by the Paderborn Football School at any time.
